They simply can't shut down servers without a court order, and there isn't a liability I can think of (or it'd be very elaborated).

Remember what got Fudge banned for example. He advertised an unofficial server that had all premium maps for free, and that you could connect to it with your regular QL client and without downloading anything.
That ran for years and id simply didn't care or know about it.

shouldnt they be able to make a case for a lawsuit since you're using their content (ie: server files, pk files, etc, which you dont own rights to)? wouldnt that be copyright infringement?

ofc they could take it to court but they won't, just like everybody else. Thing is I'd be very surprised if they shut down a server and demand a compensation without that step.
