- id software converted all Q3 maps into QL maps and gave us (up until today) 6 additional maps.
- we played those maps for the past two years and grew tired of em.
- today, id software is finally bringing us some new (and old) maps for QL.
- now you're telling us that we should play Q3 again, using the same maps we grew tired of as an argument

don't get me wrong, having those maps for Q3 is kinda neat, but marketing this as "quakelive alternative" is way off, mister.

imo hes a little overconfident in what this will achieve, but still... imo people got bored of the same maps all the time, and the map doesnt really matter much. theres enough maps to make people happy, but they choose to play the same fucking map every game. theres "ctf4 pros" who ONLY play ctf4, 98% of CA players that only play DM6, and all the other modes have their own map. i personally would be happy with all the current maps if they actually got PLAYED. but thats kinda off topic.

its more like:
-id software modified all the maps and put them in QL

Ya you're wrong. This does not constitute fair use. id owns these assets and uses them in a for-profit business model (ql).

If this were a mod for Q3 using only q3 assets that were not redistributed and/or custom made assets (like openarena) then it wouldn't be copyright infringement.

However that is irrelevant - copyright automatically applies to any creative work, and you have no automatic right to redistribute them. The only right to either the q3 or ql maps that you have comes from e EULA, which grants you a limited right to use it, but doesn't grant redistribution rights.

Therefore, it is not a breach of the Eula, but a copyright infringement, since that is the law that states you do not have permission to redistribute copyrighted works without permission.

It is true that you need to credit the original author, supply copyright information, and you also must claim fair use when doing so. As for the rest of your post, you would need to prove loss/damage, and an intent to do so - in court. If the author really is in Egypt, it's pretty much a lost cause for id.

Clearly you now agree that actually this can go a lot further than just a ban, but that actually it could go to court and they would have to try to hide behind "fair use", which is far from clear. The fact that it is depriving id of advertising income is probably enough to kill that defence dead, even without all the rest.

Clearly a c&d is likely, and if ignored could easily result in a lot worse.

It would always have to go to court for the final ruling, but it just depends if the lawyer costs (and loss) are worth it.

The highest profile fair use legal dispute I know of is shepard fairey v associated press. AP had decided to sue shepard fairey for his use of an AP photograph in his obama HOPE poster.

Fairey claimed he modified the original photograph in a way that transformed it's meaning and visual aesthetic completely.

AP claimed that Fairey required permission to use the photograph in any way, and his use of the photo was a copyright violation. The photographer for AP that took the photo loved how Fairey transformed his photo, however he believed that taking something just because you can off the internet is wrong.

I happen to agree with Fairey's position, that his work fell under fair use because of how drastically the image was modified.

Unfortunately no legal precedent was set as they both decided to settle out of court. They decided to share the rights to the HOPE campaign imagery moving forward.

This can however, help determine what can be considered fair use and what can not. Fairey, even though he had drastically modified the meaning and visuals of the original photograph, recognized that he would likely lose in a court of law. Not only did he have a chance of losing due to copyright infringement (can not guarantee a judges take on the subject), he also admitted to fabricating evidence suggested that he had not used the AP photograph. Suggesting also that he perhaps felt that he did indeed break copyright laws. I will assume that AP settled in part due to good will, from what I've read the photographer who took the photo half supported fairey, and also in case they may come out on the losing side in a court of law. After all, sharing rights and income from the Obama Hope campaign imagery, is better than nothing.

In conclusion, in a case where content was modified drastically the outcome was fuzzy at best. I think in our case involving the blatant redistribution of id software's intellectual property in an attempt to harm id software's business and sales is a clear and obvious copyright infringement, and would certainly not fall under fair use.

The slippery slope comes from the fact that he isn't American. Any venue of trying to bring a case against him would HAVE to be directly via proven damages.

how can they be new maps if they're just "modified" but (to quote you) "the general layout is the same? If you make it a different color or whatever, it still means that we've played the same map. Again, how can you call this "new". You're doing the same thing that id is, only backwards- they're bringing "old" maps to QL, while you're taking "new" maps back to Q3... at this point in QL, its all even still free (no accounts yet), so I just have to ask what you are accomplishing?

the maps are, essentially, the same, but the modifications make them a different playing experience. the map and item layouts are different, so they are played different (not incredibly differently though), so they can be considered new maps, but theyre just remakes.

and iD modified/converted the Q3 maps to QL, and we are converting the QL maps to Q3, with all their modifications from the originals. simple as that.

QU4KEZER0 is a mappack

Is it a map pack? If I throw it into "baseq3", the levels all show up and are selectable. However, a lot of them have missing textures. QZCA2 has quite a few missing textures around the doors, for example. Furthermore, QZCA1 will load, but it is pitch black... I don't even know if there is a map there through that.

If I create a "QU4KEZER0" folder in the main game directory and load it as a mod however, everything works fine. I'd rather have just a handful of the maps available through vanilla Q3A, so that I could use them with some mods.
